Hogan Lovells Cadwalader
Hogan Lovells Cadwalader is one of the top 20 largest law firms in the world, with over 2500 lawyers operating out of 45 offices in 25 countries. We deliver solutions to complex problems in a practical way by leveraging our global and local knowledge, and our vast experience of advising in highly regulated sectors and markets. Our deep industry sector knowledge enables us to stay ahead of emerging risks.
Hogan Lovells Cadwalader has a leading insurance practice of more than 250 lawyers in over 30 global offices, providing legal advice and support to a wide range of clients including corporate entities outside the insurance sector (such as policyholders and distributors of insurance) as well as clients within the insurance industry (such as insurers, reinsurers, brokers and London market entities).
Whatever sector a business operates in, insurance plays a critical role in protecting it from risk whilst helping it to succeed. Our global insurance team helps businesses in every sector with their insurance needs, providing expert strategic guidance on complex and high value matters.
We advise corporate policyholders on their insurance protections including reviewing insurance cover, advising on coverage, assisting on claims notifications and acting in situations where insurance claims are denied by insurers. We have experience in all lines of business, in particular business interruption, property damage, all forms of liability cover, credit insurance, political risk, war risks, D&O, employers’ liability, crime and fidelity and financial lines.
We advise participants to M&A and financial transactions on using transactional insurance including reviewing and negotiating policy wordings (working closely with insurers and brokers), advising on regulatory issues and helping clients navigate the claims process. We have particular expertise in warranty and indemnity and contingent insurance.
We act for non-insurers – such as banks, finance providers, payment institutions and corporate organisations – involved in the distribution of insurance-related products including designing, drafting and reviewing terms of distribution agreements (such as embedded insurance), negotiating agreement terms and advising on relevant regulatory frameworks.
We advise companies on the establishment, operation, relocation and utilisation of a captive and in tracking the regulatory landscape of captives around the world.
We act for corporates involved in pension de-risking where we can assist clients from the very start of the process – where they are considering whether pensions de-risking is the right solution for them – to the very end – where the scheme is being wound up and members are being issued with individual policies.
Our extensive client base ensures that there are very few issues that we have not come across whilst our dedicated sector-focused team is immersed in the industry, enabling us to keep our clients up to speed with legislative, regulatory and market changes. We are very familiar with the approach taken by regulators and the issues that they will focus on. This familiarity enables us to assist in managing regulatory engagement to ensure the best outcomes for our clients.
